704.12(a)(6) LICENSURE OutPatient Caseload
704.12. Full-time equivalent (FTE) maximum client/staff and client/counselor ratios.
(a) General requirements. Projects shall be required to comply with the client/staff and client/counselor ratios in paragraphs (1)-(6) during primary care hours. These ratios refer to the total number of clients being treated including clients with diagnoses other than drug and alcohol addiction served in other facets of the project. Family units may be counted as one client.
(6) Outpatients. FTE counselor caseload for counseling in outpatient programs may not exceed 35 active clients.
|
Observations Based on a review of the Staffing Requirement Facility Summary Report, the facility failed to ensure that the FTE counselor caseload for counseling in outpatient programs did not exceed 35 active clients. Ten counselors exceeded the individual 35 to 1 FTE counselor caseload and the overall facility FTE counselor caseload exceeded the 35 to 1 FTE counselor caseload.
The counselor Full Time Equivalent (FTE) is determined by dividing the total number of hours the counselor devotes to their clients by the facility's workweek. Then, to obtain the FTE ratio, the total number of clients on the counselor's outpatient caseload is divided by the FTE.
The overall facility outpatient counselor caseload ratio calculation was as follows: 50/40= 1.25(FTE); then 64/1.25= 51.2 which equals a client/counselor ratio of 51:1
Employee #4 was hired as a clinical supervisor on April 19, 2021 and was still employed at the time of the inspection. The ratio calculation was as follows: 4/40= 0.1(FTE); 4/0.1= 40 which equals a client/counselor ratio of 40:1.
Employee #5 was hired as a counselor on July 31, 2019 and was still employed at the time of the inspection. The ratio calculation was as follows: 13/40= 0.325 (FTE); 17/0.325= 52.3076 which equals a client/counselor ratio of 52:1.
Employee #6 was hired as a counselor on July 12, 2021 and was still employed at the time of inspection. The ratio calculation was as follows: 11/40= 0.275 (FTE); 16/0.275= 58.1818 which equals a client/counselor ratio of 58:1.
Employee #7 was hired as a counselor on October 25, 2021 and was still employed at the time of inspection. The ratio calculation was as follows: 6/40= 0.15 (FTE); 7/0.15= 46.6667 which equals a client/counselor ratio of 46:1.
Employee #8 was hired as a counselor on June 14, 2021 and was still employed at the time of inspection. The ratio calculation was as follows: 1/40= 0.025 (FTE); 1/0.025= 40 which equals a client/counselor ratio of 40:1.
Employee #9 was hired as a counselor on July 13, 2021 and was still employed at the time of inspection. The ratio calculation was as follows: 4/40= 0.1(FTE); 5/0.1= 50 which equals a client/counselor ratio of 50:1.
Employee #10 was hired as a counselor on February 3, 2021 and was still employed at the time of inspection. The ratio calculation was as follows: 4/40= 0.1(FTE); 4/0.1= 40 which equals a client/counselor ratio of 40:1.
Employee #11 was hired as a counselor on September 6, 2021 and was still employed at the time of inspection. The ratio calculation was as follows: 1/40= 0.025 (FTE); 1/0.025= 40 which equals a client/counselor ratio of 40:1.
Employee #12 was hired as a counselor on April 26, 2021 and was still employed at the time of inspection. The ratio calculation was as follows: 4/40= 0.1(FTE); 4/0.1= 40 which equals a client/counselor ratio of 40:1.
Employee #13 was hired as a counselor on August 23, 2021 and was still employed at the time of inspection. The ratio calculation was as follows: 2/40= 0.05 (FTE); 5/0.05= 100 which equals a client/counselor ratio of 100:1.
This finding was reviewed with facility staff during the licensing process.
|
Plan of Correction LMCMS D&A Clinical Leadership will recalculate and resubmit FTE client/counselor ratios. The new ratios will be submitted by 4/1/2022.
FTE client/counselor ratios will be tracked and reviewed on a monthly basis by the D&A Clinical Supervisor in clinical supervision with clinicians to ensure the FTE counselor caseloads for outpatient programs do not exceed 35 active clients. This will commence effective 4/1/2022.

709.28 (c) LICENSURE Confidentiality
§ 709.28. Confidentiality.
(c) The project shall obtain an informed and voluntary consent from the client for the disclosure of information contained in the client record.
|
Observations Based on a review of client records, the facility failed to complete an informed and voluntary consent to release information form prior to the disclosure of information in seven of seven client records reviewed.
In every client record reviewed, there was evidence of disclosures to the funding sources during each client's treatment episode; however, there were no consent to release information forms, signed by the clients, documented in the records prior to any of the disclosures.
This is a repeat citation from the March 2, 2021 annual licensing inspection.
This finding was reviewed with facility staff during the licensing process.

This signed acknowledgement will be uploaded into individuals' charts. This consent will be included in the intake packet and put into use starting 5/2/2022. Any intake completed prior to that date will have the consent captured through the above mentioned process.
D&A Clinicians will use an electronic signature software to capture complete consents to release of information annually and on as-needed basis. All D&A Clinicians will be trained in the use of the electronic signature software. This training will also cover how to properly complete a Release of Information to be sent out through the electronic signature software for signature. This training will occur by 5/2/2022 and full use of the electronic signature software by D&A Clinicians will roll out by 5/9/2022.
Chart audits will be conducted monthly by the D&A Clinical Supervisor, to include review of informed and voluntary consent to release of information for funding sources. Chart audits will involve no less that one chart reviewed per month. Issues identified through chart audits will be communicated directly with clinicians for rectification and will be used to assess for training needs. Chart audit results will be reviewed at high level on a quarterly basis to identify trends indicating programmatic level changes needed. First round of updated chart audits will be completed 4/30/2022.
