|
Plan of Correction The dumpster that was used from September 9 (day of first residents to arrive at the facility) was a smaller size dumpster. During the weeks prior to our licensing inspection, the number of residents at our facility increased from 8 to 14. This increase caused an overflow of trash in the smaller dumpster. On November 20, the Project Director contacted our hauling service and ordered a new larger (twice the size) dumpster. At this point, the dumpster is being picked up once per week. To date, there have been no issues of overflow of trash while using the larger size dumpster. The Project Director will monitor closely and increase pickup days from one per week to two per week, if necessary. As of now, this issue has been fully addressed and rectified. |

709.33 (a) LICENSURE Notification of termination.
§ 709.33. Notification of termination.
(a) Project staff shall notify the client, in writing, of a decision to involuntarily terminate the client ' s treatment at the project. The notice shall include the reason for termination.
|
Observations Based on a review of one applicable record, the facility failed to notify the client in writing of a decision to involuntarily terminate the client ' s treatment at the project. The notice shall include the reason for termination.Client #2 was admitted on October 17, 2021 and discharged on November 9, 2021. There was no documentation in the client record that the facility notified the client in writing of a decision to involuntarily terminate the client ' s treatment at the project. These findings were reviewed with facility staff during the licensing process.
|
Plan of Correction Previously, an involuntary discharge was preceded by either a breach in a behavior contract or refusal to sign a behavior contract, upon request by either the Project Director, Clinical Supervisor, Programs Manager (or a combination thereof). Documentation was done by completing discharge documentation in the EHR. We failed provide Client #2 in writing of a decision to involuntarily terminate the resident's treatment at the project.
We are currently working with our EHR provider company to develop an "Involuntary Termination of Treatment Form". The software company estimates its completion by January 12, at which time it'll be added to our EHR system and then utilized for involuntary discharges. In the interim, a temporary form has been created and approved by the Project Director to use, in case any involuntary discharges occur between today and roll-out of the form in our EHR (estimated date for full roll-out is January 21, 2022. |
709.33 (b) LICENSURE Notification of termination.
§ 709.33. Notification of termination.

Observations Based on a review of one applicable record, the facility failed to inform the client that they have an opportunity to request reconsideration of a decision terminating treatment.Client #2 was admitted on October 17, 2021 and discharged on November 9, 2021. There was no documentation in the client record that the facility notified the client that they have an opportunity to request reconsideration of a decision terminating treatment. These findings were reviewed with facility staff during the licensing process.
|
Plan of Correction Client #2 was discharged on November 9, 2021 and was not notified that he has an opportunity to request reconsideration of a decision to terminate his treatment. An attempt was made on 12/27/2021 to contact the former resident to let him know of his right to request a reconsideration to terminate his treatment. PD staff were not able to reach Client #2.
Going forward, a new form has been created for the resident being involuntarily discharged to request reconsideration of termination of treatment. This form was completed and approved by the Project Director on 1/3/2022 and reviewed with all members of the management and counseling teams. This form will be used for all involuntary discharges and will be uploaded into the resident's record in the EHR. |
709.51(b)(2)(iii) LICENSURE Fee Schedule
709.51. Intake and admission.
(b) Intake procedures shall include documentation of:
(2) Client orientation to the project which includes, but it is not limited to, a familiarization with:
(iii) Fee schedule.
|
Observations Based on a review of seven client records, the facility failed to have intake procedures that included documentation of the client orientation to the project which includes a familiarization with the fee schedule in all records reviewed. These findings were reviewed with facility staff during the licensing process.
|
Plan of Correction A fee schedule is being developed now by the Project Director and Programs Manager. A meeting with our accountant is being scheduled to review the fee schedule. Input from the local SCA and our HealthChoices network providers will be sought, prior to fully implementing the fee schedule. Once the fee schedule is approved and fully implemented (by 2/1/2022), residents will sign off stating that the fee schedule was discussed with them during the intake process. |
709.51(b)(5) LICENSURE Physical Examination
709.51. Intake and admission.
(b) Intake procedures shall include documentation of:
(5) Physical examination.
|
Observations Based on a review of seven client records, the facility failed to have intake procedures that included documentation of a physical examination in two out of four applicable records reviewed.Client #4 was admitted on October 5, 2021 and was current at the time of the inspection. There was no documentation of a physical examination in the client record. Client #7 was admitted on October 13, 2021 and was current at the time of the inspection. There was no documentation of a physical examination in the client record. These findings were reviewed with facility staff during the licensing process.
|
Plan of Correction Currently, our facility accepts physical exams completed at a referring facility as a component of the intake process, as long as physical exams are completed within the previous 12 months, prior to date of admission into our program.
Client #4 was admitted as a self-referral on 10/5/2021. As such, no physical exam was completed and sent to us from a referring facility. Client #4 was scheduled and attended an appointment with a primary care physician that was set up by the client and his counselor. Client #4 attended his physical examination appointment. We are currently waiting for his paperwork to be given to us.
Client #7 was admitted as a self-referral on 10/5/2021. As such, no physical exam was completed and sent to us from a referring facility. Client #4 was scheduled and attended an appointment with a primary care physician that was set up by the client and his counselor. Client #4 attended his physical examination appointment. We are currently waiting for his paperwork to be given to us.
As a result of physicians being backlogged with appointment requests at the times of admission of both Client #4 and Client #7, it took over a month to get them an appointment with their PCP. The Project Director, Clinical Supervisor, and Programs Manager met to address this concern. We did find a physician group, Caring Health Network that has been accepting our residents and getting them in to appointments with teh doctor right away.
To ensure that our residents get physicals in a timely manner upon arrival, we will primarily utilize the physician group referenced above.
As a backup, we will contract with either a Physician Assistant or Nurse Practitioner (CRNP) on an as-needed basis (PRN) before March 1, 2022. The process of searching for either a PA or CRNP has begun. |
709.52(c) LICENSURE Provision of Counseling Services
709.52. Treatment and rehabilitation services.
(c) The project shall assure that counseling services are provided according to the individual treatment and rehabilitation plan.
|
Observations Based on a review of seven client records, the facility failed to assure that counseling services are provided according to the individual treatment and rehabilitation plan in two of four applicable records reviewed. Client #4 was admitted on October 5, 2021 and was current at the time of the inspection. Client #4 ' s treatment and rehabilitation plan dated November 5, 2021 listed individual sessions four times a week. Only one individual session was documented each week. Client #6 was admitted on September 17, 2021 and was current at the time of the inspection. Client #6 ' s treatment and rehabilitation plan dated October 8, 2021 listed individual sessions five times a week. Only one individual session was documented each week. The only documented individual sessions in client record following the treatment and rehabilitation plan were on October 11, 2021 and October 30, 2021. These findings were reviewed with facility staff during the licensing process.
|
Plan of Correction Our facility is new and is using a new Electronic Health Record (EHR) system. As such, staff are still learning the system. There were errors by two counselors when developing treatment plans, to include showing more individual counseling sessions than are being offered.
Client #4's treatment and rehabilitation plan dated November 5, 2021 listed individual sessions four times a week in error. The residents get one mandatory counseling session per week (and others as needed/counselor or counselor assistant is available). The treatment plan has been fixed/updated to show one (1) individual counseling session per week.
Client #6's treatment and rehabilitation plan dated October 8, 2021 listed individual sessions five times a week in error. Only one (1) session was held and was documented each week. The residents get one mandatory counseling session per week (and others as needed/counselor or counselor assistant is available). The treatment plan has been fixed/updated to show one (1) individual counseling session per week. Also, with Client #6, the counselor did not sign all of the notes in the EHR. As a result, the notes that were documented here as missing were there, but not signed/finalized and showing as completed in the EHR. This issue was resolved on 11/19/2021.
To avoid this from happening again, the Project Director and Clinical Supervisor are reviewing client records at least twice per week, looking at notes, reviewing treatment plans, etc.. |
709.53(a)(12) LICENSURE Work as treatment

(12) Verification that work done by the client at the project is an integral part of his treatment and rehabilitation plan.
|
Observations Based on a review of seven client records, the facility failed to develop a complete client record on an individual which includes information relative to the client's involvement with the project including verification that work done by the client at the project is an integral part of his treatment and rehabilitation plan in all seven records reviewed. These findings were reviewed with facility staff during the licensing process.

Plan of Correction Our facility failed to develop a complete client record on an individual which includes information relative to the client's involvement with the project including verification that work done by the client at the project is an integral part of his treatment and rehabilitation plan in all seven records reviewed.
We are currently in the process of full implementation of one standard ASAM treatment plan, created for us by our EHR software team, in cooperation with the Project Director, Clinical Supervisor, and Programs Manager. The treatment plan is complete and is currently being implemented for each resident, as their treatment plan update date comes due. We are working with the software company to determine where, in the ASAM criteria, it'll be best to include the resident facility work goal. We estimate this process to be completed fully by February 10, 2022. The Project Director and Clinical Supervisor will monitor progress. The Programs Manager will act as the key contact with the EHR software company. |
