Client #1 was admitted on 9/16/16 and was an active client at the time of the licensing inspection. A consent to release form, dated 9/16/16 to a criminal justice agency, did not allow for the consent to be revoked "until there has been a formal and effective termination or revocation of my release from confinement, probation, or parole, or other proceeding under which I was mandated into treatment."
Client #2 was admitted on 9/5/16 and was an active client at the time of the licensing inspection. A consent to release form, dated 9/6/16 to a criminal justice agency, did not allow for the consent to be revoked "until there has been a formal and effective termination or revocation of my release from confinement, probation, or parole, or other proceeding under which I was mandated into treatment."

A consent to release form, dated 8/29/16 to a criminal justice agency, did not allow for the consent to be revoked "until there has been a formal and effective termination or revocation of my release from confinement, probation, or parole, or other proceeding under which I was mandated into treatment."
Client #4 was admitted on 10/3/16 and was an active client at the time of the licensing inspection. A consent to release form, dated 10/3/16 to a criminal justice agency, did not allow for the consent to be revoked "until there has been a formal and effective termination or revocation of my release from confinement, probation, or parole, or other proceeding under which I was mandated into treatment."
Client #5 was admitted on 4/7/16 and was discharged 8/19/16. A consent to release form, dated 4/7/16 to a criminal justice agency, did not allow for the consent to be revoked "until there has been a formal and effective termination or revocation of my release from confinement, probation, or parole, or other proceeding under which I was mandated into treatment."
Client #6 was admitted on 2/2/16 and was discharged 6/29/16. A consent to release form, dated 4/28/16 to a treatment provider, did not contain a provision for the consent to be revoked. Additionally, there was no documentation that the client was offered a copy of the consent.
Client #7 was admitted on 2/29/16 and was discharged 6/15/16. A consent to release form, dated 2/29/16 to a criminal justice agency, did not allow for the consent to be revoked "until there has been a formal and effective termination or revocation of my release from confinement, probation, or parole, or other proceeding under which I was mandated into treatment."
Client #8 was admitted on 3/24/16 and was discharged 8/2/16. A consent to form, dated 3/24/16 to a government agency, did not allow for the consent to be revoked "until there has been a formal and effective termination or revocation of my release from confinement, probation, or parole, or other proceeding under which I was mandated into treatment."
Client #10 was admitted on 1/19/16 and was discharged 6/6/16. A consent to form, dated 3/1416 to a government agency, did not allow for the consent to be revoked "until there has been a formal and effective termination or revocation of my release from confinement, probation, or parole, or other proceeding under which I was mandated into treatment."

Plan of Correction To address areas of concern in this citation the following has occurred organization wide to address this at the facility level effective 11/30/2016.
Statement regarding the inability to revoke criminal justice consents for court mandated clients has been removed from consent forms in ECR system.
Staff reviewed revision to consent forms and client's right to revoke in staff meeting on 11/30/2016.
Clients 1, 2,4 referenced in observations are still enrolled in treatment services and will sign updated consent for any criminal justice involvement. A caseload review of all currently admitted clients by each counselor has been initiated as of 12/21 to sign updated consents for all currently enrolled clients not reviewed in this licensing visit that corrections may apply to during their individual sessions.
No additional actions are needed to support new admits into the program, as the form currently in the chart is corrected as of 11/30/2016 and only administrators have the ability to revise to avoid user error at the facility level.
An all staff training is under development for our mylearningpointe training system to launch in 2017 training year to reinforce for current and new hires.
