709.28. Confidentiality. (c) The project shall obtain an informed and voluntary consent from the client for the disclosure of information contained in the client record. The consent shall be in writing and include, but not be limited to:
Observations
Based upon a review of eight client records on June 19 & 20, 2008 and an interview with a corporate representative on May 29, 2008, the facility failed to ensure that they obtained an informed and voluntary consent from the client for the disclosure of information contained in the client records.

Seven client records were reviewed for consent to release information forms, of those seven, five client records #1, 2, 3, 4 & 5 all contained a medical release form for the release of client identifying information for urine drug screens without identifying the laboratory that the facility intended to use. The consent stated that the information could be released to a laboratory of the facility's choosing. The facility did not have a Qualified Service Organization Agreement in place with any laboratories on file.

Four of seven client records reviewed, #1, 5, 6 & 7, all contained consents to release information that were signed by the client but did not list who the information was to be released to.

Plan of Correction
Counselors will ensure that all clients sign consent forms that clearly outline where the information is going and who is requesting it. In addition the laboratory for all urine drug screenings will be noted on medical release forms and identified as the laboratory where urine drug screenings are sent. Clinical Supervisdor will review records on a weekly basis for a period of 3 months to ensure forms are being properly completed. If at the end of three months no violations were noted the Clinical Supervisor will pull records randomly on a quarterly basis to ensure continued compliance. The physical examination document in client record #2 was dated two days prior to the admission date and there was no documentation of an explanation for this anomaly. The physical examination document in client record #5 had been altered with 'white-out'.

Client #1 was admitted on 1/4/08, the physical examination document was dated 1/14/08.
