Observations Seven client records were reviewed on April 6, 2017. It was observed in seven of seven records that the facility released patient identifying information to a laboratory and failed to obtain an informed and voluntary consent or a QSOA prior to the disclosure. Additionally, for client record #7, it was observed that the facility released patient identifying information to a family member and failed to obtain an informed and voluntary consent prior to the disclosure. Client #7 was admitted into treatment on July 20, 2016 and was discharged on December 19, 2016. The record contained a consent to release information form to a family member, dated July 20, 2016, which identified that the family member was an emergency contact. The consent identified that information could be released only in the event of an emergency. The client record contained documentation that information was released that exceeded what was permissible by the consent on August 10, 2016 and August 17, 2016. Specifically, the family member was participating in family counseling sessions with the client and counselor. These findings were reviewed with facility staff during the licensing process.

Plan of Correction Program Manager has contacted laboratory regarding a QSOA. An agreement has been initiated. It is currently being reviewed by General Counsel and when signed, a copy will be provided.
Until the agreement is signed, a consent form will be signed by clients and placed in clients' chart. This began 4/7/17.
Program Manager will ensure that the above is completed and adhered to by staff.
Staff will ensure that all clients that are engaging in family counseling sessions, sign a Consent to Release Information. The consent will outline the specific information that is released/discussed.
Program Manager will facilitate a training to ensure that all staff have the consent signed and are aware of the information to be disclosed. Staff will also engage in a refresher Confidentiality Training. This will occur the week of June 5, 2017. |
