INITIAL COMMENTS

This report is a result of an on-site complaint investigation conducted on December 5, 2023 by staff from the Bureau of Program Licensure.? Based on the findings of the on-site complaint investigation, the allegations were unsubstantiated. However, Rios Recovery House, was found to be non-compliant with the applicable chapters of 28 PA Code, chapter 717, which pertain to the recovery house.

Plan of Correction

§ 717.29(b)(1)  LICENSURE Physical plant standards - Bldg-Exterior-Grnd

§ 717.29. Physical plant standards. (b) Building interior, exterior and grounds. The licensee shall: (1) Keep the interior, exterior, and grounds or yard of the drug and alcohol recovery house clean, safe, sanitary and in good repair and free of hazards at all times.
Observations
As a result of a physical plant inspection conducted by DDAP staff, the recovery house failed to keep the exterior, and grounds of the drug and alcohol recovery house clean, safe, sanitary and in good repair and free of hazards.

Findings:

It was observed that the recovery house had broken furniture on the porch also, the kitchen door is missing a window pane and is covered with cardboard.

Plan of Correction
On 12/27/2023, Rios Recovery had Adam's Glass company service our kitchen door window located at 1524 W Allen Street in Allentown PA. The window was broken in late July due to an intoxicated resident who broke through the window. The police were called and the incident was reported with authorities and DDAP. Since the incident we have placed a camera directed at the door and the resident had apologized and checked himself into treatment. The resident no longer lives at our home. Adam's Glass company repaired the kitchen window for 291 dollars which I sent pictures to Antoinette Sacco today showing the receipt and the replacement window.

Rios Recovery also had a chair located on the front porch with a missing arm. The chair was removed from the front porch and will be junked on Allentown's garbage night which is December 28th. We had an extra chair in the basement and brought that out to the front porch. I sent Antoinette Sacco pictures of the plan of corrections.

§ 717.29(d)(1)(ix)  LICENSURE Physical plant standards - Sleep accomodation

§ 717.29. Physical plant standards. (d) Sleeping accommodations. (1) Each drug and alcohol recovery house bedroom must have the following: (ix) A window with a source of natural light.
Observations
Based on a physical plant inspection during a complaint investigation the recovery house failed to comply with the following: A window with a source of natural light.

Plan of Correction
On December 14th Rios Recovery moved the resident who was living in an unapproved bedroom from DDAP due to insufficient natural light in the bedroom and moved him upstairs once the bed was available to move into. The bedroom is closed down and has been used as a storage room since. Rios Recovery will keep this room closed to abide by DDAP's rules and regulations.
