§ 717.23  LICENSURE Notification of decision to end residency

§ 717.23. Notification of decision to end residency. (a) The licensee shall notify the resident in writing of a decision to end residency. The notice must include the reason and a timeframe for ending residency. (b) The resident shall have an opportunity to request the licensee reconsider a decision to end residency before the decision to end residency takes effect. (c) The resident may decide to end residency without providing a reason to the licensee.
Observations
Based on resident record reviews and staff interviews it was determined the recovery house failed to notify the resident in writing of a decision to end residency.

Plan of Correction
Herkey Houses LLC developed and implemented a new Notification of Decision to End Residency Policy to ensure residents receive written notification of a decision to end residency in accordance with 28 Pa. Code § 717.23. The policy establishes email delivery of the completed Involuntary-Termination form as the primary method of written notification and physical delivery as the secondary method when electronic delivery is unavailable or unsuccessful. The policy also establishes procedures for documenting delivery attempts, resident refusal to sign, residents who vacate before notice can be personally delivered, and retention of the completed notice in the resident's OneStep record.

The new policy was distributed electronically to applicable staff on September 7, 2026. Management will review and discuss the new policy and documentation requirements with each applicable team member during the week of September 8?11, 2026, to ensure staff understanding and consistent implementation. Management will document completion of staff training.

Following implementation and training, management will monitor ongoing compliance through review of resident termination records to verify that written notification was provided and appropriately documented in accordance with the new policy.
