Plan of Correction

709.28 (c)  LICENSURE Confidentiality

§ 709.28. Confidentiality. (c) The project shall obtain an informed and voluntary consent from the client for the disclosure of information contained in the client record.
Observations
The facility failed to document a written, informed and voluntary consent from the client prior to the disclosure of information contained in the client record to the funding entity in one of seven client records reviewed on January 29 - 30, 2020.Client # 1 was admitted June 18, 2019. The facility released the client's name and diagnosis for prior authorization of treatment services on August 6, 2019.The findings were reviewed with facility staff during the licensing process.

Plan of Correction
In order to ensure that appropriate consent is secured prior to disclosure of information contained in the client record to the funding entity, Community Counseling Center will adhere to the following plan of correction.

1. Upon registration for services, a Fiscal Technician will secure a consent to release information for each funding entity in which the client is enrolled for payment.

2. Throughout treatment, a Fiscal Technician will monitor the client's status with associated funding entities:

a. For clients who are enrolled in the public medical assistance program, a proprietary eligibility monitoring system will be checked daily. This system sends a morning report which identifies any changes in funding sources.

b. For clients on private insurance, clients will be asked at each visit whether there have been any changes in funding sources.

3. When Community Counseling Center becomes aware of a change in funding entity for a client, the following process will ensure that an appropriate consent is obtained:

a. A Fiscal Technician will place a note on the next scheduled appointment for the client.

b. At that next appointment, the client will be approached by Clerical Staff to meet with Fiscal Technician and complete a consent.

c. A Fiscal Technician will monitor, via spreadsheet, to ensure that all requested consents are obtained .
