INITIAL COMMENTS

This report is a result of an on-site recovery house complaint investigation conducted on December 15, 2022, by staff from the Bureau of Program Licensure. Based on the findings of the on-site complaint investigation, Surge Recovery 3 was found not to be in compliance with the applicable chapters of 28 PA Code, Chapter 717, which pertains to the recovery house.

Plan of Correction

§ 717.25(b)(1)  LICENSURE Financial transactions

§ 717.25. Financial transactions. (b) The licensee shall develop and implement written policies and procedures that prohibit the licensee, staff, volunteers or contractors of the drug and alcohol recovery house from: (1) Requiring a resident to sign a document relinquishing the resident's public assistance benefits, including medical assistance benefits, cash assistance, Supplemental Security Income and Supplemental Nutrition Assistance Program benefits.
Observations
Based on an onsite investigation and staff interviews, the facility failed to follow it's written policies and procedures that prohibit the licensee and staff of the drug and alcohol recovery house from requiring a resident to sign a document relinquishing the resident's public assistance benefits, including Supplemental Nutrition Assistance Program (SNAP) benefits.

The facility was found to be collecting SNAP benefits cards and allowing a local market to place the funds into an account for the recovery house to purchase food for the entire house.

Plan of Correction
At no time will Surge Recovery collect EBT cards. Any resident that contributes to their monthly fees using SNAP benefits will retain their own EBT card. Resident food stamp fees collected will be tracked for each program using the resident fee tracker form.

§ 717.28  LICENSURE Resident requirements

§ 717.28. Resident requirements. The licensee shall develop and implement written policies and procedures that: (1) Promote and require that residents participate in treatment, self-help groups or other drug and alcohol recovery supports. (2) Require that residents abstain from use and sale of alcohol and illicit drugs, and provide consequences for failure to abstain.
Observations
Based on an onsite investigation and staff interviews, the facility failed to implement their written policies and procedures that include promoting and requiring the residents to participate in treatment, self-help groups or other drug and alcohol recovery supports. The facility also failed to require that residents abstain from use and sale of alcohol and illicit drugs and provide consequences for failure to abstain.

During the investigation, the facility reported they are not requiring any residents to participate in treatment, self-help groups or other drug and alcohol recovery supports. They are also returning the residents illicit drugs to them daily.

Plan of Correction
We have revised our D&A policy which states:

Surge Recovery will provide access to 12 Step programs and promote attendance to these

programs. Residents will be required to attend four (4) NA/AA meetings per week and have

their meeting attendance slip signed. Residents are required to submit their filled in sheet at

the end of every week. In addition, Surge Recovery will provide two (2) life skill groups per day

on site. Life skill groups include, but are not limited to, job training, resume writing, importance

of family, and relapse prevention.

Surge Recovery requires that residents abstain from the use and sale of alcohol and illicit drugs,

and will provide appropriate consequences for failure to abstain.

If a resident use drugs while in Surge recovery that is grounds for discharge. Every effort will be

made to work with the resident through behavioral contracts and treatment plans. If these

interventions fail and the resident continues to use drugs this will result in discharge.
