Observations Based on a review of the findings of an investigation by the Fayette Single County Authority (SCA) and a follow-up with the facility director, the project failed to secure client records within a locked storage container.
The findings include:
On June 15, 2012, a complaint investigation was conducted by the Fayette SCA. A review of these findings indicated a sheet of paper that included client identifying information was found in the garbage receptacle located behind the facility. This client identifying information was not secured within a locked storage container and could have been viewed by the general public. The facility failed to protect the confidentiality of client records.
An interview conducted with the project director and facility director on August 7, 2012 confirmed these findings.

Plan of Correction We received an anonymous message which notified us that "we shut down the women center and now we are going to shut down the men's center". Fayette SCA arrived and immediately informed Another Way they had a compliant that female records were placed in the dumpster. The SCA went into the dumpster and pulled out paperwork. They did not show or give the paperwork to the CEO or the Facility Director. The Facility Director was informed by the DDAP Licensing Specialist that the document was a list of female names and identifing information. The list of names did not contain any of Another Way's information. All employees reviewed and signed the confidentiality violation policy in early June 2012. The agency developed an Internal Record Destruction Policy which states what protected client identifing information is and the procedure to destroy said information. The Facility Director will continue to monitor and educate staff. They agency will be in full compliance after board approval of policy and all employees sign off on the policy which will then be included in their personal files by 9/30/12. |
