704.6(e)  LICENSURE Supervisory Meetings

704.6. Qualifications for the position of clinical supervisor. (e) Clinical supervisors are required to participate in documented monthly meetings with their supervisors to discuss their duties and performance for the first 6 months of employment in that position. Frequency of meetings thereafter shall be based upon the clinical supervisor's skill level.
Observations
Based on a review of personnel records, the facility failed to document that the clinical supervisor participated in monthly meetings with their supervisor to discuss their duties and performance for the first six months of employment in that position in one of one personnel record.

The findings include:

Personnel records were reviewed on September 21, 2012. Two personnel records were reviewed for the clinical supervisor position. One personnel record required the documentation of monthly meetings between the clinical supervisor and their supervisor for the first six months of employment in that position. The facility failed to document monthly supervision meetings in personnel record # 3.

Employee # 3 was hired at the project on October 28, 2003 and was promoted to the position of clinical supervisor on April 19, 2012. Monthly supervision meetings were required to take place in April, May, June, July, and August of 2012. There was no documentation of monthly supervision meetings in the personnel record of employee # 3.

An interview with the project director and clinical supervisors took place on September 21, 2012 at which time it was confirmed that there was no documentation of monthly supervision meetings.

Plan of Correction
The Clinical Director meets with the Clinical Coordinator on a bi-weekly basis. These Supervision sessions will now be documented on a form the Clinical Director has developed specifically for that purpose. These meetings results forms will be maintained chronologically by the Clinical Director.

As per New Insights policy, the Executive Director will make sure that any new clinical staff member, who qualifies as a new supervisor, will have documented sessions with their supervisor on a regular basis for the first six months of employment in that position. This plan of action will be initiated on 9/26/2012.

704.11(c)(2)  LICENSURE CPR CERTIFICATION

704.11. Staff development program. (c) General training requirements. (2) CPR certification and first aid training shall be provided to a sufficient number of staff persons, so that at least one person trained in these skills is onsite during the project's hours of operation.
Observations

The findings include:

The CPR certification cards and First Aid certification cards were reviewed on September 21, 2012. The facility's hours of operation are; Monday through Thursday 9 am - 9 PM, Friday 9 am - 5 PM and Saturday 9 am - 1 PM. There were times where only one staff member had a current CPR certification on varied shifts and one time period that the facility did not have any coverage.

Monday - Lack of sufficient coverage 5 PM to 9 PM

Tuesday- Lack of sufficient coverage from 5 PM to 9 PM

Wednesday - Lack of sufficient coverage 5 PM to 6:30 PM and no coverage from 6:30 PM to 9 PM

An interview with project director on September 21, 2012 confirmed the findings. This is a repeat citation from the May 16-17, 2012 licensing inspection.

Plan of Correction
The Executive Director made adjustments to the staff schedule that will go into effect on October 1, 2012. This staff schedule change will provide for a minimum of two (2) employees on duty during all hours of operation.

The Executive Director will assure that adequate coverage will remain intact by completing the CPR/First Aid coverage grid on a quarterly basis. This will take in to account any possible changes in employee work schedules or personnel changes.

This standard will be in full compliance by October 1, 2012.

709.28(c)  LICENSURE Confidentiality

709.28. Confidentiality. (c) The project shall obtain an informed and voluntary consent from the client for the disclosure of information contained in the client record. The consent shall be in writing and include, but not be limited to:
Observations
Based on the review of client records, the facility failed to ensure that an informed and voluntary consent to release information was obtained in four of twelve patient records reviewed. The facility also exceeded 4 Pa. Code, Subsection 255.5(a) (6) by releasing too much information to the employer in one of twelve records reviewed.

The facility had the client sign a consent to release that allowed for the client's location and length of stay. Additionally, this record had a letter faxed " To Whom it May Concern" on August 20, 2012. A consent to release could not be verified for this letter due to the letter not being written to a specific person or entity.

A review of record # 9 documented couples counseling took place on August 30, 2012 with the patient's wife. The facility failed to obtain an informed and voluntary consent from the client for his wife.

Plan of Correction
The Clinical Coordinator will review with the clinical staff in the staff meeting on 10/24/2012 that an informed and voluntary consent is required for any and all members that attend a family or couples counseling session or group.
