The facility failed to obtain an informed and voluntary consent from the client in one of four client records reviewed on March 17, 2017
Four client records were reviewed. In client record # 2, a letter had been sent to the probation officer. There was no consent to release the information documented in the record.
The findings were reviewed with the facility staff during the licensing process.

Plan of Correction
The staff person who was involved with this error is no longer employed with ARC Manor, so this error could not be corrected with the individual staff person. However, this error was reviewed with all Clinical staff during the weekly Clinical Staff meeting on March 23rd so that all staff are aware of the importance of ensuring that releases are on file before sending information.
The Clinical Director monitors compliance with this issue during monthly supervision with all Clinical Staff. During individual clinical supervision, 10% of all clinical files are spot-checked to ensure compliance. |
