Observations
The facility failed to ensure that there was a valid client consent in place prior to the release of confidential client information.
Client #1 was admitted to treatment on 04/27/18 and discharged on 05/08/18. Facility staff reported that information was released from client #1's treatment record to an emergency contact on 05/08/18. Additionally, the facility reported that the client had revoked his consent to this party prior to the release of information by facility staff.

Plan of Correction
This was addressed with the staff person on 5/9/18. In addition, the Clinical Director and Director of Nursing re-educated the Clinical and Nursing staff on the confidentiality laws regarding consents to release information during the month of May, 2018. New staff are trained on confidentiality during new hire orientation and all staff are re-educated during annual training in October. Attendance at annual training is mandatory for all staff and tracked by our Administrative Assistant. Effective June, 2018 ten discharge charts will be reviewed monthly by QI to ensure compliance with confidentiality regarding the consents to release information. |
