INITIAL COMMENTS

This report is a result of an on-site licensure renewal inspection conducted on November 15, 2006 through November 16, 2006 by staff from the Division of Drug and Alcohol Program Licensure. The following deficiencies were identified during this inspection and a plan of correction is due on December 12, 2006.

Plan of Correction

704.3 (b)  LICENSURE Recruitment and Hiring

704.3. General requirements for projects. (b) The project shall develop a policy that addresses the recruitment and hiring of staff persons who are appropriate to the population to be served. Every effort shall be made to hire staff persons representative of that population.
Observations
A policy addressing the recruitment and hiring of staff persons who are appropriate and representative of the population to be served was not provided.

Plan of Correction
The director has placed a Policy 704.3 (b) addressing recruitment and hiring of staff persons who are appropriate and representative of the population to be served. The policy has been drafted therefore, this citation will not happen again.

704.9(a)  LICENSURE Counselor Asst Supervision

704.9. Supervision of counselor assistant. (a) Supervision. A counselor assistant shall be supervised by a full-time clinical supervisor or counselor who meets the qualifications in 704.6 or 704.7 (relating to qualifications for the position of clinical supervisor; and qualifications for the position of counselor).
Observations
The counselor assistant is being supervised by the program director, who is not a full-time clinical supervisor or counselor.

Plan of Correction
The Director is supervising the counselor assistant due to being short staffed and not having a second clinican available for supervision. An advertisement or position announcement was placed in the Patriot newspaper on 11/19/06 and runs regularly on the agency website. The newspaper ad will run at least once a month until the positon of Counselor is filled. The ad was placed and the corrective date reflects when the ad was placed, however, there is no way to give a date as to when a counselor will be hired. The steps to ensure the deficiency won't happen again is non-existence being that the program has no control over turnover or when a staff person may quit. This facility is prepared to place ads in the newspaper monthly to increase a speedy transition in recruiting staff. The counselor assistant was not hired without there being a qualified counselor. The counselor who was qualified to supervise the counselor assistant resigned, leaving the counselor assistant with no supervisor besides the director. The corrective plan remains that the program will hire a fulltime counselor to supervise the counselor assistant and that the regular practice of not hiring a counselor assistant without there being a qualified counselor will continue to be the standard. A third ad was placed in the Patriot News 1/20/07 and interviews are being scheduled. The program plans to fill the open position of Counselor by February 20, 2007.

704.10  LICENSURE Counselor Asst Promotion

704.10. Promotion of counselor assistant. (a) A counselor assistant who satisfactorily completes one of the sets of qualifications in 704.7 (relating to qualifications for the position of counselor) may be promoted to the position of counselor. (b) A counselor assistant shall document to the facility director that he is working toward counselor status. This information shall be documented upon completion of each calendar year. (c) A counselor assistant shall meet the requirements for counselor within 5 years of employment. A counselor assistant who has accumulated less than 7,500 hours of employment during the first 5 years of employment will have 2 additional years to meet the requirements for counselor. (d) A counselor assistant who cannot meet the time requirements in subsection (c) may submit to the Department a written petition requesting an exception. The petition shall describe the circumstances that make compliance with subsection (c) impracticable and shall be approved by both the clinical supervisor or lead counselor and the project director. Granting of the petition will be within the discretion of the Department.
Observations
The counselor assistant is not currently working toward a degree.

Plan of Correction
The counselor assistant was hired without knowledge of the requirements of promoting to counselor. Therefore, there has been no action to fulfill the requirements for licensure in section 704.10. Policy 704.10 states that a Counselor Assistant MAY be promoted and outlines the necessary steps to obtain the Counselor position. However, the counselor in question does not wish to be promoted and so the interpretation of the regulations reads as optional. The director discussed the promotion of the counselor with the counselor assistant who has expressed no interest in a promotion or pursuing a degree. The program will submit an exemption request asking for this requirement to be waived considering the staff was hired without notice that she would need to receive a degree in 5 years. The policy regarding the promotion of a counselor assistant was understood to be an option due to the wording of the policy. The agency has set a goal of getting a counselor hired to replace the counselor assistant by February 20, 2007.

Plan of Correction
The Director designed a questionnaire soliciting training ideas, interests, and needs. The Director will administer the questionnaire during the first month of the year and the Dierctor will develop a training plan from the feedback. The questionnaire will be adminstered 1/10/07 and the training plan will be completed by January 31, 2007. Completeting these steps each year will ensure the deficiency does not recur.

704.11(a)(2)  LICENSURE Overall Training plan

The project director shall develop a comprehensive staff development program for agency personnel including policies and procedures for the program indicating who is responsible and the time frames for completion of the following components: (2) An overall plan for addressing these needs.

Observations
The required 6 hours of HIV/AIDS training and 4 hours of TB/STD training was missing in one of eleven personnel records reviewed, #8.

Plan of Correction
Personnel #8 is the Executive Director/CEO of Catholic Charities and does not have any direct contact with the clients at the facility. In addition, the CEO does not provide direct supervision to the Director of the program. See organizational chart. Entities may obtain information without any procedures or requirements.

The director updated all releases to include the removal of "obtain informtion" verbage. Also added, was the wording "revoke verbally." These changes will be completed by January 12, 2007.
