Plan of Correction

709.28 (c) (1)  LICENSURE Confidentiality

§ 709.28. Confidentiality. (c) The project shall obtain an informed and voluntary consent from the client for the disclosure of information contained in the client record. The consent must be in writing and include, but not be limited to: (1) Name of the person, agency or organization to whom disclosure is made.
Observations
Ten client records were reviewed on October 4, 2016, the facility failed to document an informed and voluntary consent in client record #10. The facility sent a letter, dated July 15, 2016, with client identifying information to the department of probation and parole addressed to a particular agent. The facility failed to have a consent to release on file for this agent.

These findings were reviewed with facility staff during the licensing process.

Plan of Correction
D&A program Director met with client record #10's primary counselor to discuss the citation of completing the voluntary release of information consent. The primary counselor was instructed to identify as in the case "Department of Probation and Parole and Delegate". The primary counselor only identified Department of Probation and Parole and sent a letter to the agent identified in the letter. The primary counselor acknowledges the error and will henceforth identity appropriately as instructed. A clinical staff meeting will be held on Monday, October 24th and this will be explained and discussed with all counselors. The release of information forms will be monitored for correctness through random chart checks conducted by the clinical supervisor and the standard admit,60,90 day chart checks completed by counselors and/or Clinical Supervisor.
