INITIAL COMMENTS

This report is a result of an on-site licensure renewal inspection conducted on January 29-30, 2008 by staff from the Division of Drug and Alcohol Program Licensure. Based on the findings of the on-site inspection, Gateway Erie was found not to be in compliance with the applicable chapters of 28 PA Code which pertain to the facility. The following deficiencies were identified during this inspection and a plan of correction is due on February 29, 2008.

Plan of Correction

704.6(a)  LICENSURE Clinical Supervisor Qualifications

704.6. Qualifications for the position of clinical supervisor. (a) A drug and alcohol treatment project shall have a full-time clinical supervisor for every eight full-time counselors or counselor assistants, or both.
Observations
Based on a review of the facility summary report and the calculation of the client/counselor ratio on 1-30-08, the facility failed to provide a full time clinical supervisor for every eight full time equivalent counselors.

Plan of Correction
The addition of a Full Time Clinical supervisor would present a hardship that the program could not indure.

A re analysis of the data presented to the department indicated 8.125 staff FTE's at the time of inspection.

By reducing the clinical hours of the staff at Gateway Erie we can achieve FTE's of six. Considering a previous waiver of a ratio of 10::1. the ratio of patients to staff for work release at the time of inspection would equate to four FTE's for a census of forty for work release.

The inpatient requirement of 8::1.would require 1.75 FTE'S. We are staffing with two FTE's. The total FTE's is six.

In addition the requirement for Out patient at the Erie County Prison is 35::1. We had reported 1.2 FTE's. Considering that half the therapists hours are devoted to an unlicensed program. we will reduce the ETE's to .75 FTE's. This will adequately cover a census of six patients at the time of inspection.

The total aggregate of staff FTE's would equal 6.75; well below the eight FTE's, and providing a caseload for couselors that is within the requirements of staffing requirements.

704.7. Qualifications for the position of counselor.
