INITIAL COMMENTS

This report is a result of an on-site inspection conducted for the approval to use a narcotic agent, specifically methadone and buprenorphine, in the treatment of narcotic addiction. This inspection was conducted on October 25-27, 2010 by staff from the Division of Drug and Alcohol Program Licensure. Based on the findings of the on-site inspection, Net Treatment Services, Inc. - Net Steps, was found not to be in compliance with the applicable chapters of 4 PA Code and 28 PA Code which pertain to the facility. The following deficiencies were identified during this inspection and a plan of correction is due on December 12, 2010.

Plan of Correction

715.23(b)(5)  LICENSURE Patient records

(b) Each patient file shall include the following information: (5) The results of all annual physical examinations given by the narcotic treatment program which includes an annual reevaluation by the narcotic treatment physician.
Observations
Based on the review of patient records, the facility failed to complete the annual physical with a re-evaluation by the physician in three of six patient records reviewed.

The findings include:

Sixteen patient records were reviewed on October 27, 2010, six were required to provide documentation of annual physicals and re-evaluation of the patient. Of these records, three did not document the annual re-evaluation of the patient

Patient # 9 was admitted 6-16-05. The annual physical exam was completed on 6-18-10 by the Certified Physician Assistant (PAc), but did not include a re-evaluation by the physician.

Patient # 12 was admitted 5-28-09. The annual physical exam was completed on 5-18-10 by the Certified Physician Assistant (PAc), but did not include a re-evaluation by the physician.

Patient # 15 was admitted 6-12-08. The annual physical exam was completed on 6-12-10 by the Certified Physician Assistant (PAc), but did not include a re-evaluation by the physician.

Plan of Correction
NET Steps has stopped using a Physicians Assistant as of July 2010 thus eliminating/correcting all of the citations.

NET Steps does not intend to use Physicians Assistants in the future. It is understood if Physician Assistants are used that the NTP Physican/Medical Director must document the evaluation & re-evaluation on each patient service rendered (by the PAc).

Medical Director and Facility Director are responsible for the employment/non employment of Physicians Assistants.

Time Line: POC is effective 11-24-10
