Based on the findings of an onsite unannounced home care agency state re-licensure survey conducted on April 17, 2025, Angels On Call, was found to be in compliance with the requirements of 28 Pa. Code, Health Facilities, Part IV, Chapter 51, Subpart A.

Based on the findings of an onsite unannounced home care agency state re-licensure survey conducted on April 17, 2025, Angels On Call, was found not to be in compliance with the requirements of 28 Pa. Code, Health Facilities, Part IV, Chapter 611, Subpart H. Home Care Agencies and Home Care Registries.

611.52(c) LICENSURE
Federal Criminal History Record

Name - Component - 00
If the individual required to submit or obtain a criminal history report has not been a resident of this Commonwealth for the 2 years immediately preceding the date of the request for a criminal history report, the individual shall obtain a federal criminal history record and a letter of determination from the Department of Aging, based on the individual ' s Federal criminal history record, in accordance with the requirements at 6 PA. Code § 15.144(b) (relating to procedure).

Observations:



Based upon personnel file review and an interview with the agency administrator, it was determined that the agency failed to ensure documentation of a federal criminal history record and a letter of determination from the Pennsylvania Department of Aging, for direct care workers who have not been a resident of the Commonwealth for the previous two years prior to hire for one (1) out of seven (7) personnel files (PF) reviewed (PF#5).

Findings include:

Personnel files were reviewed on 4/17/25 from approximately 10:00 AM -11:00 AM revealing the following:

PF#5 (Date of hire (DOH) 8/29/2024): File contained a Florida Driver's License with no other evidence of residency. No documentation of a federal criminal history record and a letter of determination from the Pennsylvania Department of Aging present in the file.

An interview with the agency administrator on 4/17/25 at approximately 11:15 AM confirmed the above findings.





Plan of Correction:

FBI for Residency
Agency has a policy which is consistent with the regulation to ensure FBI checks are completed when unable to prove residency. Agency will retrain office staff on the above-mentioned policy, that is consistent with regulation, to ensure staff are aware of what documents are acceptable to prove residency. If residency cannot be proven by said documents, the employee will be scheduled for a Department of Aging FBI background check.
Moving forward, The Office Manager and/or the Regional Manager will be responsible for reviewing all onboarding information, upon Date of Hire, to determine if proof of residency exists or if the new employee needs to be sent for an FBI background check through the Department of Aging.
Proof of residency will be tracked on the Personnel File Checklist to ensure all requirements are met at the time of onboarding.
Compliance Department Staff reviewed the files for compliance as employees were onboarded.
Agency Staff will run Department of Aging Federal Criminal Backgrounds on the following files reviewed:
PF#1
Results will be placed in the staff file.

PF#1 will be placed on a provisional hire with weekly calls and weekly visits until results of FBI are received.
