Initial Comments:


Based on the findings of an announced onsite state licensure complaint survey completed December 21, 2021, Americas Home Health Services, Llc. was found not to be in compliance with the requirements of 28 Pa. Code, Health Facilities, Part IV, Chapter 611, Subpart H. Home Care Agencies and Home Care Registries.

611.52(a) LICENSURE
Criminal Background Checks

Name - Component - 00
The home care agency or home care registry shall require each applicant for employment or referral as a direct care worker to submit a criminal history report obtained at the time of application or within 1 year immediately preceding the date of application.

Observations:


Based on a review of employee files and an interview with the agency Chief Executive Officer, the agency failed to submit a criminal history report obtained at the time of application or within 1 year immediately preceding the date of application for one (1) out of three (3) employee files (EF) reviewed (EF#3).

Findings include:

A review of EFs was conducted on December 21, 2022 at approximately 10:15 a.m. Employee date of hire (DOH) is listed below.

EF#3 DOH 07/14/22: No documentation provided of criminal history report being obtained at the time of application or within 1 year (365 days) immediately preceding the date of application. Documentation provided of a criminal history report being conducted on 12/21/22, the day of the onsite survey.


An interview conducted with agency Chief Executive Officer on December 21, 2022 at approximately 12:00 p.m. confirmed the above findings.








Plan of Correction:

1. EF#3 was missing the her state police criminal background check from her employee file. State police was run and found to have no background on 12/21/22.

2. Review of all active caregiver files will be conducted within the branch to ensure that all background results are uploaded into axiscare profile. An excel spreadsheet will be completed to document this review.

3. AHHS uses Slack to document any/all new hires, there is a channel within Slack labeled backgrounds in which the branch documents the new hires name to notify the Director of Compliance to complete the background check.

4. With the use of Slack the background will be run when posted in the channel and the Director will upload the document whether pending or complete into Axiscare profile. At the end of each day an email is sent to all branches confirming their new hires for the day.

5. Director of Compliance or designee will contact each branch at the end of each day to request any new hire information.


611.57(c) LICENSURE

(c) Prior to the commencement of services, the home care agency or home care registry shall provide to the consumer, the consumer's legal representative or responsible family member an information packet containing the following information in a form that is easily read and understood: (1) A listing of the available home care services that will be provided to the consumer by the direct care worker and the identity of the direct care worker who will provide the services. (2) The hours when those services will be provided. (3) Fees and total costs for those services on an hourly or weekly basis. (4) Who to contact at the Department for information about licensure requirements for a home care agency or home care registry and for compliance information about a particular home care agency or home care registry. (5) The Department's complaint Hot Line (1-800-254-5164) and the telephone number of the Ombudsman Program located with the local Area Agency on Aging (AAA). (6) The hiring and competency requirements applicable to direct care workers employed by the home care agency or referred by the home care registry. (7) A disclosure, in a format to be published by the Department in the Pennsylvania Bulletin by February 10, 2010, addressing the employee or independent contractor status of the direct care worker providing services to the consumer, and the resultant respective tax and insurance obligations and other responsibilities of the consumer and the home care agency or home care registry.

Observations:


Based on a review of consumer files, the consumer admission packet, and an interview with the agency Chief Executive Officer, the agency failed to provide the consumer, prior to the commencement of services, a listing of the available home care services that will be provided to the consumer by the direct care worker and/or the identity of the direct care worker who will provide the services and who to contact at the Department (717-783-1379) for information about licensure requirements for a home care agency or home care registry and for compliance information for three (3) out of three (3) consumer files (CF) reviewed (CF#1-CF#3), and failed to provide the consumer, prior to the commencement of services, the hours when those services will be provided for two (2) out of two (2) consumer files (CF) reviewed (CF#1, CF#2),

Findings include:

A review of CFs was conducted on December 21, 2022 at approximately 10:00 a.m. Consumers start of service (SOS) is listed below.

CF#1 SOS 07/05/22: No documentation provided of the agency providing the consumer, prior to the commencement of services, a listing of the available home care services that will be provided to the consumer by the direct care worker, who to contact at the Department (717-783-1379) for information about licensure requirements for a home care agency or home care registry and for compliance information, nor the hours when those services will be provided.

CF#2 SOS 07/12/22: No documentation provided of the agency providing the consumer, prior to the commencement of services, a listing of the available home care services that will be provided to the consumer by the direct care worker and the identity of the direct care worker who will provide the services, who to contact at the Department (717-783-1379) for information about licensure requirements for a home care agency or home care registry and for compliance information, nor the hours when those services will be provided.

CF#3 SOS 06/16/22: No documentation provided of the agency providing the consumer, prior to the commencement of services, a listing of the available home care services that will be provided to the consumer by the direct care worker and who to contact at the Department (717-783-1379) for information about licensure requirements for a home care agency or home care registry and for compliance information.


An interview conducted with agency Chief Executive Officer on December 21, 2022 at approximately 12:00 p.m. confirmed the above findings.

Plan of Correction:

1. CF#1-3 were missing the departments phone number for licensure requirements and compliance information, this phone number has been added to the welcome packet, CF#1-3 did not have the list of services completed on their welcome letters; all letters have been updated with the appropriate tasks, CF#1 did not have service hours listed on the letter; this has been added to the letter, CF#2 did not list the caregivers name on the letter, this has been added to the letter. All letters have been redistributed to the clients that were monitored.

2. All clients will have new welcome letters distributed so that everyone has the compliance and licensure phone number needed.

3. The client welcome packet has been updated and will be distributed to the branch today 1/5/23 for all new clients moving forward.

4. Director of Home Care will be reviewing all new client files prior to the start of care to be sure that all opening documents are completed fully and uploaded into Axiscare.
