Based on the findings of an onsite home care agency state re-licensure survey and complaint survey conducted on April 22 2025, April 23, 2025, and offsite on April 28, 2025, May 1, 2025, May 5, 2025 and May 7, 2025. Aveanna Healthcare, was found to be in compliance with the requirements of 28 Pa. Code, Health Facilities, Part IV, Chapter 51, Subpart A.

Aveanna Healthcare, was found to not be in compliance with the requirements of 28 Pa Code Health Facilities, part IV, Chapter 611, Subpart H. Home Care Agencies and Home Care Registries.

611.57(a) LICENSURE Consumer Rights Name - Component - 00 (a) The consumer of home care services provided by a home care agency or through a home care registry shall have the following rights: (1) To be involved in the service planning process and to receive services with reasonable accommodation of individual needs and preferences, except where the health and safety of the direct care worker is at risk. (2) To receive at least 10 calendar days advance written notice of the intent of the home care agency or home care registry to terminate services. Less than 10 days advance written notice may be provided in the event the consumer has failed to pay for services, despite notice, and the consumer is more than 14 days in arrears, or if the health and welfare of the direct care worker is at risk.
Observations:
Based on a review of consumer records (CR's) and visit calendar, and an interview with the administrator, the agency did not provide service with reasonable accommodation of individual needs and preferences except where the health and safety of the direct care worker is at risk for one (1) of three (3) CRs. (CR #1).

A review of consumer records (CR's) and visit calendar was conducted on April 22, 2025, at approximately 10:32 a.m. and April 23, 2024, at approximately 9:52 a.m.
CR # 1 Start of Care: 2/26/2025, Receive services via waiver from UMPC. Hours authorized from February 25, 2025, to January 18, 2026, - 3936.25. Twelve (12) hours per day, 7 days a week.
A review of agency calendar shows the week of March 2, 2025, through March 8, 2025. Late visits on March 3, 2025, from 11:59-21:04. Late visits on March 4, 2025, from 10:30-15:26. Late visits on March 6, 2025, from 10:27-16:06. Late visits on March 7, 2025, from 12:00-21:00.
The week of March 9, 2025, through March 15, 2025, Late visits on March 10, 2025, from 10:28-21:01. Late visits on March 11, 2025, from 09:20-21:03. Late visits on March 13, 2025, from 09:30-21:03.
The week of March 16, 2025, through March 22, 2025, missed visits on March 16, 2025, missed visit note aide had family emergency. Late visits on March 17, 2025, from 09:45-21:00. Late visits on March 18, 2025, from 09:45-21:07. Late visits on March 19, 2025, from 09:53-21:00. Late visits on March 20, 2025, from 09:13-21:17. Late visits on March 21, 2025, from 09:23-21:12. March 22, 2025, from 09:00-12:56 staff left around 1 p.m. another staff filled in 14:30-21:05.

An interview with the Administrator was conducted on April 23, 2025, at 11:26 a.m. confirmed the above findings.
Plan of Correction:Aveanna Healthcare (Agency) will provide a reasonable accommodation of individuals needs and preferences. We will make sure to uphold that right by notifying consumers of any change in caregiver and/or shift time. Aveanna will have clear documentation of notification to consumer. All Internal staff will be re-educated on this process.
