Based on the findings of an unannounced onsite state home care agency re-licensure survey conducted on December 7, 2022, Bello Nurses, LLC was found to be in compliance with the requirements of 28 Pa. Code, Health Facilities, Part IV, Chapter 51, Subpart A.

Based on the findings of an unannounced onsite home care agency state re-licensure survey conducted on December 7, 2022, Bello Nurses, LLC was found not to be in compliance with the requirements of 28 Pa. Code, Health Facilities, Part IV, Chapter 611, Subpart H. Home Care Agencies and Home Care Registries.

(c) Prior to the commencement of services, the home care agency or home care registry shall provide to the consumer, the consumer's legal representative or responsible family member an information packet containing the following information in a form that is easily read and understood: (1) A listing of the available home care services that will be provided to the consumer by the direct care worker and the identity of the direct care worker who will provide the services. (2) The hours when those services will be provided. (3) Fees and total costs for those services on an hourly or weekly basis. (4) Who to contact at the Department for information about licensure requirements for a home care agency or home care registry and for compliance information about a particular home care agency or home care registry. (5) The Department's complaint Hot Line (1-800-254-5164) and the telephone number of the Ombudsman Program located with the local Area Agency on Aging (AAA). (6) The hiring and competency requirements applicable to direct care workers employed by the home care agency or referred by the home care registry. (7) A disclosure, in a format to be published by the Department in the Pennsylvania Bulletin by February 10, 2010, addressing the employee or independent contractor status of the direct care worker providing services to the consumer, and the resultant respective tax and insurance obligations and other responsibilities of the consumer and the home care agency or home care registry.

Observations:

Based on review of consumer files (CFs), the consumer admission packet, and an interview with the agency Owner, Office Manager, and Human Resources Manager, the agency failed to provide the consumer, prior to commencement of services for: 1. Hours for provided services in two (2) of five (5) CFs (CF#1, CF#3); 2. Fees and total costs for services per hour in three (3) of five (5) (CF#1, CF#2, CF#3); 3. Correct information on the Consumer Notice of Direct Care Worker (DCW) Status form in three (3) out of five (5) CFs (CF#1, CF#3, CF#4).


Findings include:


A review of CFs and consumer admission packet was conducted on December 5, 2022, at approximately 9:00 AM. Start of Care date (soc) is listed below.

CF#1 soc 8/16/2022, no documentation hours for provided services; service fees and total costs per hour; and missing correct designation of DCW status, missing consumer initials for agency staff status, and missing consumer date of document agreement.

CF#2 soc 9/5/2022, no documentation for service fees and total costs per hour.

CF#3 soc 6/1/2021, no documentation hours for provided services; service fees and total costs per hour; and incorrect documentation of DCW status marked (both), missing consumer name (top of document page) and missing agency staff agreement date on document.

CF#4 soc 7/1/2020, incorrect documentation of DCW status marked (both).

Interview conducted on December 7, 2022, at approximately 12:30 PM with the agency Owner, Office Manager, and Human Resources Manager confirmed the above findings.









Plan of Correction:

1. On 12/12/20225, agency Clinical Supervisor will re-educate responsible consumer enrollment staff regarding complete documentation of service plan agreement Costs of Services, Weekly Schedule for Services, Service Hours, accurate Direct Care Worker Tax Status, and dates for agency staff signature and consumer name.

2. On 12/12/2022, agency Enrollment staff will update/correct Consumer files #1 -3 with all observed missing information.

3. On 12/12/2022, agency Clinical Supervisor will initiate a process to monitor new consumer filings of service plan agreement forms for all required provided consumer information.

4. Beginning 01/31/2023 and for each calendar quarter 2023, agency Clinical Supervisor will review all new enrolled consumers for all required personal service agreement provided information. Audit results will be reported to agency Owner.

Based on the findings of an unannounced onsite home care agency state re-licensure survey conducted on December 7, 2022, Bello Nurses, LLC was found to be in compliance with the requirements of 35 P.S. 448.809 (b).
