INITIAL COMMENTS
 
This report is a result of an on-site licensure renewal inspection conducted on November 20, 2020 by staff from the Department of Drug and Alcohol Programs, Bureau of Quality Assurance for Prevention and Treatment. Based on the findings of the on-site inspection, A Better Today Hazelton was found not to be in compliance with the applicable chapters of 28 PA Code which pertain to the facility. The following deficiencies were identified during this inspection:
 
Plan of Correction

709.28 (c) (2)  LICENSURE Confidentiality

§ 709.28. Confidentiality. (c) The project shall obtain an informed and voluntary consent from the client for the disclosure of information contained in the client record. The consent must be in writing and include, but not be limited to: (2) Specific information disclosed.
Observations
Based on a one of eight client records reviewed, the facility failed to keep disclosures of client identifying information within the limits established by 4 Pa. Code 255.5 (b) for releases of information to employers in client record #5.

Client # 5 was admitted on April 14, 2020 and discharged on June 8, 2020. An informed and voluntary consent from the client for the disclosure of information contained in the client record to an employer allowed for the release of client prognosis, nature of the project, a brief description of the client's progress, a short statement as to whether the client relapsed into drug and alcohol abuse and the frequency of such relapse.

These findings were reviewed with facility staff during the licensing process.
 
Plan of Correction
According to 4 Pa. Code 255.5 (b)(6), Projects may disclose with the consent of a client, in writing, the information to employers of a client to further the rehabilitation of a client; or, to a prospective employer who affirmatively expresses that information is sought to enable the employer to engage the client as an employee. Such information shall be limited to whether the client has or is receiving treatment with the project.



Will remain limited to only whether the client has or is receiving treatment when it comes to employers and client released information.



All staff including Clinical Director is responsible for this action. Clinical Director will notify all staff of this and it will be implemented into practice from 12-14-2020 forward.
