INITIAL COMMENTS
 
This report is a result of an on-site licensure renewal inspection conducted on April 19, 2017 by staff from the Department of Drug and Alcohol Programs, Bureau of Quality Assurance for Prevention and Treatment, Program Licensure Division. Based on the findings of the on-site inspection, Lehigh Valley Drug and Alcohol Intake Unit was found not to be in compliance with the applicable chapters of 28 PA Code which pertain to the facility. The following deficiencies were identified during this inspection:
 
Plan of Correction

709.28 (c)  LICENSURE Confidentiality

§ 709.28. Confidentiality. (c) The project shall obtain an informed and voluntary consent from the client for the disclosure of information contained in the client record.
Observations
Based on the review of client records, the facility failed to document a completed informed and voluntary consent to release information form in 2 of 7 records reviewed.



Client #4 was seen for an evaluation on 12/28/2016. A consent to release information form to the funding source, dated 12/28/16, did not contain the specific information to be disclosed and the purpose of the disclosure. Additionally, a consent to release information form to the emergency contact, dated 12/28/16, did not contain the specific information to be disclosed.

Client #5 was seen for an evaluation on 03/01/2017. A consent to release information form to the a family member, dated 03/01/17, did not contain the specific purpose of the disclosure.

The findings were reviewed with facility staff during the licensing inspection.
 
Plan of Correction
Executive Director and Clinical Director will review confidentiality regulations with all assessors. Directors will also review "consent to release information" and review what can be released and what cannot be release to specific entities. Staff Meeting for in service will be completed by May 3, 2017. Files will be monitored on a quarterly basis to assure compliance with proper completion of Consent forms.
