INITIAL COMMENTS
 
This report is a result of an off-site complaint investigation conducted on July 1, 2022 by staff from the Bureau of Program Licensure. Based on the findings of the off-site complaint investigation, Habit Opco, Inc. - Pottstown was found not to be in compliance with the applicable chapters of 28 PA Code which pertain to the facility.
 
Plan of Correction

709.28 (a) (1)  LICENSURE Confidentiality

§ 709.28. Confidentiality. (a) A written procedure shall be developed by the project director which shall comply with 4 Pa. Code § 255.5 (relating to projects and coordinating bodies: disclosure of client-oriented information). The procedure must include, but not be limited to: (1) Confidentiality of client identity and records. Procedures must include a description of how the project plans to address security and release of electronic and paper records and identification of the person responsible for maintenance of client records.
Observations
Based on a conversation with the facility director and a review of the confidentiality policy, the facility failed to keep a client's identity confidential. A client was identified to a State Police officer on facilit grounds prior to a consent form being signed by the client and prior to the officer providing any type of legal documentation or signed court order.
 
Plan of Correction
On 7/15/22, during the monthly staff meeting, the Clinic Director reviewed Acadia Policies, along with State and Federal, Confidentiality polices with all staff. Training included proper presentation and questions to be posed to any authoritative parties who call or physically present on site, seeking to connect with or contact with a specific patient.



The Administrative Team will ensure that all such contacts are reviewed by the Clinic Director for follow up; Regional Director will also be engaged in this process as needed.



Confidentiality review and trainings will continue on a Quarterly basis throughout the year as part of the Monthly staff meeting and will continue as part of all new hires on-boarding and training.



Clinic Director will review any updates and needs to same during weekly Management Team meetings...
