(3) Testing for hospices that provide inpatient care directly. The hospice must conduct exercises to test the emergency plan twice per year. The hospice must do the following:
(i) Participate in an annual full-scale exercise that is community-based; or
(A) When a community-based exercise is not accessible, conduct an annual individual facility-based functional exercise; or
(B) If the hospice experiences a natural or man-made emergency that requires activation of the emergency plan, the hospice is exempt from engaging in its next required full-scale community based or facility-based functional exercise following the onset of the emergency event.
(ii) Conduct an additional annual exercise that may include, but is not limited to the following:
(A) A second full-scale exercise that is community-based or a facility based functional exercise; or
(B) A mock disaster drill; or
(C) A tabletop exercise or workshop led by a facilitator that includes a group discussion using a narrated, clinically-relevant emergency scenario, and a set of problem statements, directed messages, or prepared questions designed to challenge an emergency plan.
(iii) Analyze the hospice's response to and maintain documentation of all drills, tabletop exercises, and emergency events and revise the hospice's emergency plan, as needed.

(A) When a community-based exercise is not accessible, conduct an annual individual, facility-based functional exercise.
(B) If the [LTC facility] facility experiences an actual natural or man-made emergency that requires activation of the emergency plan, the LTC facility is exempt from engaging its next required a full-scale community-based or individual, facility-based functional exercise following the onset of the emergency event.
(ii) Conduct an additional annual exercise that may include, but is not limited to the following:
(A) A second full-scale exercise that is community-based or an individual, facility based functional exercise; or
(B) A mock disaster drill; or
(C) A tabletop exercise or workshop that is led by a facilitator includes a group discussion, using a narrated, clinically-relevant emergency scenario, and a set of problem statements, directed messages, or prepared questions designed to challenge an emergency plan.
(iii) Analyze the [LTC facility] facility's response to and maintain documentation of all drills, tabletop exercises, and emergency events, and revise the [LTC facility] facility's emergency plan, as needed.

A tabletop exercise is led by a facilitator and includes a group discussion, using a narrated, clinically relevant emergency scenario, and a set of problem statements, directed messages, or prepared questions designed to challenge an emergency plan. If the OPO experiences an actual natural or man-made emergency that requires activation of the emergency plan, the OPO is exempt from engaging in its next required testing exercise following the onset of the emergency event.
(ii) Analyze the OPO's response to and maintain documentation of all tabletop exercises, and emergency events, and revise the [RNHCI's and OPO's] emergency plan, as needed.

(d)(2) Testing. The RNHCI must conduct exercises to test the emergency plan. The RNHCI must do the following:
(i) Conduct a paper-based, tabletop exercise at least annually. A tabletop exercise is a group discussion led by a facilitator, using a narrated, clinically-relevant emergency scenario, and a set of problem statements, directed messages, or prepared questions designed to challenge an emergency plan.
(ii) Analyze the RNHCI's response to and maintain documentation of all tabletop exercises, and emergency events, and revise the RNHCI's emergency plan, as needed.

Based on documentation review and interview, it was determined the facility failed to conduct required emergency preparedness exercises in the last calendar year.

Findings include:

1. Document review and interview on February 20, 2024, between 9:15 am and 10:30 am, revealed the facility lacked documentation to support emergency preparedness exercises, conducted within the last calendar.

Interview at the time of the exit conference with the facility administrator on February 20, 2024, at 12:10 pm, confirmed the facility failed to exercise the emergency preparedness plan.




 Plan of Correction - To be completed: 03/26/2024

Facility is unable to retroactively conduct an emergency preparedness exercise for the previous calendar year.
An emergency preparedness exercise was scheduled.
Maintenance staff were educated on the need to have an annual emergency preparedness exercise.
An audit will be conducted to ensure that emergency preparedness exercises has occurred during the current calendar year of 2024

Based on a Medicare/Medicaid Recertification Survey completed on February 20,2024, it was determined that Highlands Healthcare and Rehabilitation Center was not in compliance with the following requirements of the Life Safety Code for an existing health care occupancy.
Compliance with the National Fire Protection Association's Life Safety Code is required by 42 CFR 483.90(a).

This is a three story, Type II (000) unprotected, noncombustible, fully sprinklered building, with a basement.




 Plan of Correction:


NFPA 101 STANDARD Building Construction Type and Height:Least serious deficiency but was found to be widespread throughout the facility and/or has the potential to affect a large portion or all the residents. This deficiency has the potential for causing no more than a minor negative impact on the resident.

Based on observation and interview, it was determined the facility failed to maintain building construction requirements, affecting four of four floors

Findings include:

1. Observation on February 20, 2024, at 9:00 am, revealed the facility is three stories in height, exceeding the maximum allowable story height for the building construction type, which is documented to be Type II (000).

Interview at the time of the exit conference with the facility administrator on February 20, 2024, at 12:10 pm, confirmed the facility exceeded the maximum allowable story height by one floor.






 Plan of Correction - To be completed: 03/26/2024

Bids are being collected from local contractors for areas of FSES completion. The company Environmental Services team will review the bids and along with facility leadership, will make the final plans for the necessary corrections needed to comply with the regulations. Facility is requesting that an FSES be conducted.
NFPA 101 STANDARD Alcohol Based Hand Rub Dispenser (ABHR):This is a less serious (but not lowest level) deficiency and affects more than a limited number of residents, staff, or occurrences. This deficiency is one that results in minimal discomfort to the resident or has the potential (not yet realized) to negatively affect the resident's ability to achieve his/her highest functional status. This deficiency was not found to be throughout this facility.
Alcohol Based Hand Rub Dispenser (ABHR)
ABHRs are protected in accordance with 8.7.3.1, unless all conditions are met:
* Corridor is at least 6 feet wide
* Maximum individual dispenser capacity is 0.32 gallons (0.53 gallons in suites) of fluid and 18 ounces of Level 1 aerosols
* Dispensers shall have a minimum of 4-foot horizontal spacing
* Not more than an aggregate of 10 gallons of fluid or 135 ounces aerosol are used in a single smoke compartment outside a storage cabinet, excluding one individual dispenser per room
* Storage in a single smoke compartment greater than 5 gallons complies with NFPA 30
* Dispensers are not installed within 1 inch of an ignition source
* Dispensers over carpeted floors are in sprinklered smoke compartments
* ABHR does not exceed 95 percent alcohol
* Operation of the dispenser shall comply with Section 18.3.2.6(11) or 19.3.2.6(11)
* ABHR is protected against inappropriate access

Name: MAIN BUILDING 01 - Component: 01 - Tag: 0325

Based on observation and interview, it was determined the facility failed to monitor the installation of alcohol base hand rub dispensers (ABHR), affecting two of four floors.

Findings include:

1. Observation on Feburary 20, 2024, between 11:02 a.m., and 11:37 a.m., revealed the following:

a At 11:02 a.m., 3rd floor between rooms 320/321, ABHR dispenser located less than one inch from an electrical outlet.
b At 11:04 a.m., 3rd floor between rooms 318/319, ABHR dispenser located less than one inch from an electrical outlet.
c At 11:16 a.m., 3rd floor between rooms 312/313, ABHR dispenser located less than one inch from an electrical outlet.
d At 11:37 a.m., 2nd floor between rooms 209/208, ABHR dispenser located less than one inch from an electrical outlet.

Interview at the time of the exit conference with the facility administrator on February 20, 2024, at 12:10 p.m., confirmed the ABHRs were installed too close to an ignition source.






 Plan of Correction - To be completed: 03/26/2024

The alcohol based hand rub dispensers between rooms 320/321, rooms 318/319, rooms 312/313, rooms 209/208 were relocated to locations greater than 1 inch from all electrical outlets.
An audit was performed to ensure that other hand rub dispensers were not located within one inch of an electrical outlet.
Education was provided to the maintenance employees on proper placement of hand rub dispensers.
A designee will conduct weekly audits x 6 weeks to ensure other hand rub dispensers are not located within one inch of an electrical outlet.

NFPA 101 STANDARD Sprinkler System - Maintenance and Testing:This is a less serious (but not lowest level) deficiency and affects more than a limited number of residents, staff, or occurrences. This deficiency is one that results in minimal discomfort to the resident or has the potential (not yet realized) to negatively affect the resident's ability to achieve his/her highest functional status. This deficiency was not found to be throughout this facility.
Sprinkler System - Maintenance and Testing
Automatic sprinkler and standpipe systems are inspected, tested, and maintained in accordance with NFPA 25, Standard for the Inspection, Testing, and Maintaining of Water-based Fire Protection Systems. Records of system design, maintenance, inspection and testing are maintained in a secure location and readily available.

Based on observation and interview, it was determined the facility failed to maintain the automatic sprinkler system affecting four of four floors.

Findings include:

1. Document review and interview on February 20, 2024, between 9:15 am and 10:30 am, revealed the facility could not produce documentation of a sprinkler water storage tank interior inspection.

Exit interview with the Facility Administrator at 12:10 p.m., on Feburary 20, 2024, confirmed the lack of interior water tank inspection documentation.

2. Observation on Feburary 20, 2024, between 10:32 a.m., and 10:35 a.m., revealed the following:

a. At 10:32 a.m., the fire department connection located at the exterior wall of the trash collection room, lacked an FDC (fire department connection) placard.

b. At 10:35 a.m., the fire department connection located at the exterior wall near the generator, lacked an FDC (fire department connection) placard.

Exit interview with the Facility Administrator at 12:10 p.m., on Feburary 20, 2024, confirmed the automatic sprinkler system deficiencies.




 Plan of Correction - To be completed: 03/26/2024

The facility is unable to retroactively have the sprinkler water storage tank inspected.
FDC Placards were added to the fire department connections located at the exterior wall of the trash room and to the exterior wall near the generator.
An inspection of the sprinkler water storage tank was scheduled.
Education was provided to the maintenance employees to ensure fire department connects were noted with a FDC placard.
A designee will conduct audits of the fire department connections to ensure that the placards are maintained weekly x6 weeks.

NFPA 101 STANDARD Corridor - Doors:This is a less serious (but not lowest level) deficiency and affects more than a limited number of residents, staff, or occurrences. This deficiency is one that results in minimal discomfort to the resident or has the potential (not yet realized) to negatively affect the resident's ability to achieve his/her highest functional status. This deficiency was not found to be throughout this facility.
Corridor - Doors
Doors protecting corridor openings in other than required enclosures of vertical openings, exits, or hazardous areas resist the passage of smoke and are made of 1 3/4 inch solid-bonded core wood or other material capable of resisting fire for at least 20 minutes. Doors in fully sprinklered smoke compartments are only required to resist the passage of smoke. Corridor doors and doors to rooms containing flammable or combustible materials have positive latching hardware. Roller latches are prohibited by CMS regulation. These requirements do not apply to auxiliary spaces that do not contain flammable or combustible material.
Clearance between bottom of door and floor covering is not exceeding 1 inch. Powered doors complying with 7.2.1.9 are permissible if provided with a device capable of keeping the door closed when a force of 5 lbf is applied. There is no impediment to the closing of the doors. Hold open devices that release when the door is pushed or pulled are permitted. Nonrated protective plates of unlimited height are permitted. Dutch doors meeting 19.3.6.3.6 are permitted. Door frames shall be labeled and made of steel or other materials in compliance with 8.3, unless the smoke compartment is sprinklered. Fixed fire window assemblies are allowed per 8.3. In sprinklered compartments there are no restrictions in area or fire resistance of glass or frames in window assemblies.

Based on observation and interview, it was determined the facility failed to maintain corridor doors in two locations, affecting two of four floors.

Findings include:

1. Observation on Feburary 20, 2024, between 11:01 a.m., and 11:48 a.m., revealed the following:

a. At 11:01 a.m., 3rd floor door, Room 321 door was not smoke-tight when latched in the frame.
b. At 11:48 a.m., 1st floor, The kitchen corridor door failed to latch into door frame when tested.

Interview at the time of the exit conference with the facility administrator on February 20, 2024, at 12:10 p.m., confirmed the corridor door deficiences.



 Plan of Correction - To be completed: 03/26/2024

The door to room 321 was modified to be smoke-tight when latched. The kitchen corridor door was modified so that it will latch when tested.
A building audit was conducted to ensure that no other corridor doors were unable to latch smoke tight.
Education was provided to the maintenance staff to ensure that all corridor doors were able to latch smoke tight.
A designee will audit the corridor doors weekly x6 weeks to ensure that all doors remain able to latch smoke tight.
