Initial Comments:


Based on the findings of an offsite followup survey completed 3/28/2018, Community Resources for Independence, Inc. had not corrected the deficiencies cited under PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart H, Chapter 611, Home Care Agencies and Home Care Registries. The deficiencies were cited as a result of a relicensure survey completed 2/3/2017.

Proof of Residency

The home care agency or home care registry may request an individual required to submit or obtain a criminal history record to furnish proof of residency through submission of any one of the following documents:
(1) Motor vehicle records, such as a valid driver ' s license or a State-issued identification.
(2) Housing records, such as mortgage records or rent receipts.
(3) Public utility records and receipts, such as electric bills.
(4) Local tax records.
(5) A completed and signed, Federal, State or local income tax return with the applicant ' s name and address preprinted on it.
(6) Employment records, including records of unemployment compensation

Observations:


Based on a review of plan of correction (POC), personnel files (PFs) and staff interview, it was determined the agency failed to verify proof of residency in this Commonwealth for the 2 years preceding the date of hire (DOH) for one (1) of three (3) of PFs reviewed (PF2).

Findings include:

Review of the plan of correction on 3/29/2018 at approximately 1:00 PM revealed: 611.52(d) Proof of Residency...has revised its policy and form to require new employees to provide proof of residency in Pennsylvania for at least the two years prior to hire. Acceptable documents are to include: (1) Motor vehicle records, such as a valid driver's license or a State-issued identification. (2) Housing records, such as mortgage records or rent receipts. (3) Public utility records and receipts, such as electric bills. (4) Local tax records. (5) A completed and signed, Federal, State or local income tax return with the applicant's name and address preprinted on it. (6) Employment records, including records of unemployment compensation. If a new employee cannot provide proof of residency in Pennsylvania for at least the two years prior to hire, the employee is to obtain a Federal criminal history record and a letter of determination from the Department of Aging, based on the individual's Federal criminal history record. PF #1, 4, 5, 8 and 10 shall be required to provide proof of residency in Pennsylvania for at least the two years prior to hire. If satisfactory proof of residency cannot be provided, these employees will be subject to a Federal criminal history record and a letter of determination from the Department of Aging... staff will review other current employees for proof of residency and obtain as necessary...will alter its systems to ensure that the problem does not recur by: In addition, corporate HR will review incoming new employee hire information to double-check that satisfactory proof of residency has been obtained by the facility. Corrections shall be in place by March 24, 2017."
A review of PF #2 date of hire (DOH) 4/11/2017, on 3/29/2018 at approximately 1:37 PM revealed: The document provided by the agency to confirm residency was an employer's W-2 2015 earnings statement. There was no date on the document that confirmed when the employee's date of hire was for the company in 2015. There was no additional documentation in PF to confirm proof of residency in this Commonwealth for two (2) years immediately preceding the date of hire.




Plan of Correction:

PF file with DOH of 4/11/17 has a copy of a Pennsylvania Drivers License issued 3/30/15, expiring 2/18/19, with a Pennsylvania address, and supported by a PA Department of Transportation 3-year driver record issued 4/21/17, also showing the same PA address. This demonstrates that the employee did reside within Pennsylvania for the two years prior to hire. Copies of these documents can be provided upon request.

Please note that since the time of the February 3, 2017 survey, CRI has replaced both office staff in the Indiana office. The replacement staff person responsible for employee records has been trained in employee residency verification for FBI background check purposes, and will be re-trained as part of this POC by April 30, 2018. This re-training will be documented.
