Based on the findings of an onsite unannounced state licensure survey completed 4/09/2019, Achieva Support was found to be in compliance with the requirements of PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart A, Chapter 51.

Based on the findings of an onsite unannounced state licensure survey completed 4/09/2019, Achieva Support was found not to be in compliance with the following requirement(s) of PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart H, Chapter 611, Home Care Agencies and Home Care Registries.

Proof of Residency

The home care agency or home care registry may request an individual required to submit or obtain a criminal history record to furnish proof of residency through submission of any one of the following documents:
(1) Motor vehicle records, such as a valid driver ' s license or a State-issued identification.
(2) Housing records, such as mortgage records or rent receipts.
(3) Public utility records and receipts, such as electric bills.
(4) Local tax records.
(5) A completed and signed, Federal, State or local income tax return with the applicant ' s name and address preprinted on it.
(6) Employment records, including records of unemployment compensation

Observations:

Based on review of direct care worker (DCW) personnel files (PF), and staff interview, the agency failed to ensure six (6) of ten (10) DCW personnel files reviewed contained proof of residency (PF2, PF5, PF6, PF8 - PF10).

Findings included:

A review of DCW personnel files was conducted on 4/09/2019 between 11:00 a.m. and 1:00 p.m. revealed:

PF2 was hired on 5/15/2018 and contained a PA Driver's license issued on 8/10/2017; not 2 years preceding the date of hire. PF contained no other documentation to show requirement was met.

PF5 was hired on 7/05/2018 and contained a PA Driver's license issued on 3/25/2017; not 2 years preceding the date of hire. PF contained no other documentation to show requirement was met.

PF6 was hired on 11/07/2018 and contained a PA Driver's license issued on 8/08/2018; not 2 years preceding the date of hire. PF contained no other documentation to show requirement was met.

PF8 was hired on 9/05/2017 and contained a PA Driver's license issued on 11/15/2016; not 2 years preceding the date of hire. PF contained no other documentation to show requirement was met.

PF9 was hired on 7/09/2018 and contained a PA Driver's license issued on 8/17/2017; not 2 years preceding the date of hire. PF contained no other documentation to show requirement was met.

PF10 was hired on 5/25/2017 and contained a PA Driver's license issued on 4/29/2017; not 2 years preceding the date of hire. PF contained no other documentation to show requirement was met.

Interview with EMP2 on 4/09/2019 at approximately 1:00 p.m. confirmed findings.

Revised Submission:

Based on the findings of the unannounced PA Department of Health (DOH) licensure survey completed on 4/9/2019, ACHIEVA Support Home and Community Support and the Human Resources Department has reviewed and will implement the following Plans of Correction:

Audit all current Home Health employees' personnel files for proof of PA residency two (2) years prior to their hire date within the next 30 days. Human Resources Department employees will conduct this audit. For any employees without proof of residency, Human Resources employees will direct and assist the employees in obtaining a Federal criminal history record and letter of determination from the Department of Aging based on the individual's Federal criminal history record. The Human Resources Manager will monitor the process and progress weekly and at the conclusion of 30 days to ensure compliance as well as report the progress and results to the Vice President, Home and Community Support and Vice President, Human Resources.
All future and new Home Health employees will be required to provide proper proof of PA residency 2 years prior to their hire date. Human Resources Department employees will secure proof of residency during the New Hire onboarding process. Proof of residency will be verified through the submission of a valid PA Driver License or a PA state-issued identification. Without proof of residency, the new hire shall obtain a Federal criminal history record and letter of determination from the Department of Aging, based on the individual's Federal criminal history record. The Human Resources Manager will monitor and ensure the process is followed monthly.

Based on the findings of an onsite unannounced state licensure survey completed 4/09/2019, Achieva Support was found to be in compliance with the requirements of 35 P.S. 448.809 (b).
