Initial Comments:

Based on the findings of an onsite unannounced state relicensure survey completed 7/30/2018, Dubois Home Care was found to be in compliance with the requirements of PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart A, Chapter 51.

Based on the findings of an onsite unannounced state relicensure survey completed 7/30/2018, Dubois Home Care was found not to be in compliance with the following requirement of PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart H, Chapter 611, Home Care Agencies and Home Care Registries.

Proof of Residency

The home care agency or home care registry may request an individual required to submit or obtain a criminal history record to furnish proof of residency through submission of any one of the following documents:
(1) Motor vehicle records, such as a valid driver ' s license or a State-issued identification.
(2) Housing records, such as mortgage records or rent receipts.
(3) Public utility records and receipts, such as electric bills.
(4) Local tax records.
(5) A completed and signed, Federal, State or local income tax return with the applicant ' s name and address preprinted on it.
(6) Employment records, including records of unemployment compensation

Observations:

Based on review of direct care worker (DCW) personnel files (PF), and staff (EMP) interview, the agency failed to ensure four (4) of ten (10) DCW personnel files reviewed contained proof of residency (PF6, PF8 - PF10).

Findings included:

A review of DCW personnel files was conducted on 7/30/2018, between 12:30 p.m. and 2:00 p.m.

PF6 was hired on 8/29/2016 and contained a PA Driver's license but the license was issued on 4/03/2015; not 2 years preceeding the date of hire. PF contained no other documentation to show requirement was met.

PF8 was hired on 6/28/2017 and contained a PA Driver's license but the license was issued on 1/15/2016; not 2 years preceeding the date of hire. PF contained no other documentation to show requirement was met.

PF9 was hired on 6/08/2018 and contained a PA Driver's license but the license was issued on 5/25/2018; not 2 years preceeding the date of hire. PF contained no other documentation to show requirement was met.

PF10 was hired on 6/11/2018 and contained a PA Driver's license but the license was issued on 1/06/2018; not 2 years preceeding the date of hire. PF contained no other documentation to show requirement was met.

Interview with EMP1 on 7/30/2018 at approximately 2:05 p.m. confirmed findings.






Plan of Correction:

To be in compliance with PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart H, Chapter 611, Home Care agencies and Home care Registries DuBois home care will implement a pre-screening process to assure each individual being hired submits proof of residency that is preceding 2 years the date of hire. The following form will be kept in each DCW file to display the date the information was obtained as well as copies of one of the following: (1) Motor vehicle records, such as a valid driver ' s license or a State-issued identification. (2) Housing records, such as mortgage records or rent receipts. (3) Public utility records and receipts, such as electric bills. (4) Local tax records. (5) A completed and signed, Federal, State or local income tax return with the applicant ' s name and address preprinted on it. (6) Employment records, including records of unemployment compensation. The director of the home care agency will implement as well as monitor this plan of correction to assure that each employee has the new form in place as well as the supporting documentation. The four charts that were found to be non-complaint, each employee will have five business days to submit the needed information and a screen will be completed. If employees do not submit needed information within the timeframe, they will not be scheduled with any consumers until the information is obtained and filed in their chart. The Director of Dubois home care will be responsible to see that those four charts are in compliance and that each employee submit needed information within the timeframe. The director will also be responsible to see that if the timeframe is not met for the needed information that the DCW does not provide services to any consumers until information is obtained. This is to assure that each employee has the proper documentation to support the criminal background checks that were conducted, and for any new hires to support the proper background check was conducted to meet the regulatory compliance required for direct care workers caring for consumers.
