Initial Comments:

Based on the findings of an unannounced on-site state licensure survey conducted on November 19 and 21, 2018, Aveanna Healthcare was found not to be in compliance with the requirements of 28 Pa. Code, Part IV, Health Facilities, and Subpart G. Chapter 601.

The home health agency and its staff
are in compliance with all applicable
Federal, State and Local Laws and
regulations.

Observations:

Based on review of personnel files and interview with the agency's administrator, the agency failed to ensure Pennsylvania State Police criminal background checks were performed within 30 days of hire for three (3) of twelve (12) personnel files. Personnel file # 2, 6 and 9.
Findings include: According to the Act 169 of 1996 as amended by Act 13 of 1997,"If the applicant/employee has been a resident of the Commonwealth of Pennsylvania for 2 or more years prior to application for employment, the applicant will need to obtain a clearance from the Pennsylvania State Police. This clearance is obtained by doing the following: Request for Criminal Record Check Form (SP4-164)." "When the applicant/employee has not been a resident of the Commonwealth of Pennsylvania for the entire two years (without interruption) immediately preceding the date of application for employment or currently lives out of state, in addition to the Pennsylvania State Police Criminal History Check, the applicant/employee will also need to obtain an FBI Criminal History Check. Facilities are defined by the act to include: Domiciliary Care Homes, Home Health Care Agency, Nursing Facility (licensed by the Department of Aging), and Personal Care Home (licensed by the Department of Public Welfare). A Home Health Care Agency is further defined to include those agencies licensed by the Department of Health and any public or private organization which provides care to a care-dependent individual in their place of residence." "If entities run into special circumstances where they need to hire an employee before the results of their record checks are returned, there is a provision in CPSL that allows for a provisional hiring period. The period is to not exceed 30 days for in state residents and 90 for out of state residents."
Review of personnel files on November 21, 2018 from 1230 to 1400 revealed:

Review of personnel file # 2 with a hire date of January 12, 2017, no documentation of a current completed Pennsylvania State Police criminal history check. Criminal background check was completed on January 15, 2016. Review of personnel file # 6 with a hire date of August 1, 2017 no documentation of a current completed Pennsylvania State Police criminal history check. Criminal background check was completed on December 16, 2014.

Review of personnel file # 9 with a hire date of March 12, 2018 August 1, 2017 no documentation of a current completed Pennsylvania State Police criminal history check. Criminal background check was completed on May 7, 2014.

Interview with the administrator on November 21, 2018 at 1500 confirmed that there was no documentation of a timely criminal history check for the above employees per agency policy.









Plan of Correction:

HR staff has been re-educated on the following hiring requirements:
criminal background checks must be completed within 1 year prior to hire or at time of hire.

Director to audit 100% of all new hires for next 30 days, 50% of all new hires for next 30 days and then 25% of all new hires for the next 30 days. At baseline, will begin process to audit 10% of all new hires per quarter.
