INITIAL COMMENTS
 
This report is a result of an onsite follow-up inspection pertaining to the plans of correction for the May 17, 2012 methadone monitoring inspection. The follow-up inspection was conducted on January 31, 2013 by staff from the the Division of Drug and Alcohol Program Licensure. Based on the findings of the onsite follow-up inspection, Center for Behavioral Health-HA, Inc was found not to be in compliance with the applicable chapters of 28 PA Code which pertain to the facility. The following deficiencies were identified during this inspection.
 
Plan of Correction

715.6(e)  LICENSURE Physician Staffing

(e) A physician assistant or certified registered nurse practitioner may perform functions of a narcotic treatment physician in a narcotic treatment program if authorized by Federal, State and local laws and regulations, and if these functions are delegated to the physician assistant or certified registered nurse practitioner by the medical director, and records are properly countersigned by the medical director or a narcotic treatment physician. One-third of all required narcotic treatment physician time shall be provided by a narcotic treatment physician. Time provided by a physician assistant or certified registered nurse practitioner may not exceed two-thirds of the required narcotic treatment physician time.
Observations
Based on the review of medical personnel timesheets, the facility failed to document that one-third of all required narcotic treatment physician time was provided by a narcotic treatment physician.



The medical personnel timesheets were reviewed on January 31, 2013. The medical personnel timesheets were reviewed for the months of October, November, December, 2012 and January, 2013. The facility did not document that one-third of all required narcotic treatment physician time to be provided by a narcotic treatment physician for the weeks of October 7 and 28, November 11 and 18, December 2, 9, 16, 23 and 30, 2012 and January 6, 13 and 20, 2013.



The census was 448 for the week of October 7, 2012. One-third of all required narcotic treatment physician time to be provided by a narcotic treatment physician was 14.9 hours. The narcotic treatment physician timesheets reviewed documented 14 hours.



The census was 449 for the week of October 28, 2012. One-third of all required narcotic treatment physician time to be provided by a narcotic treatment physician was 14.9 hours. The narcotic treatment physician timesheets reviewed documented 13 hours.



The census was 451 for the week of November 11, 2012. One-third of all required narcotic treatment physician time to be provided by a narcotic treatment physician was 15 hours. The narcotic treatment physicians timesheets reviewed documented 12 hours.



The census was 451 for the week of November 18, 2012. One-third of all required narcotic treatment physician time to be provided by a narcotic treatment physician was15 hours. The narcotic treatment physician timesheets reviewed documented 12 hours.



The census was 446 for the week of December 2, 2012. One-third of all required narcotic treatment physician time to be provided by a narcotic treatment physician was 14.8 hours. The narcotic treatment physician timesheets reviewed documented 12 hours.



The census was 442 for the week of December 9, 2012. One-third of all required narcotic treatment physician time to be provided by a narcotic treatment physician was 14.7 hours. The narcotic treatment physician timesheets reviewed documented 12 hours.



The census was 439 for the week of December 16, 2012. One-third of all required narcotic treatment physician time to be provided by a narcotic treatment physician was 14.6 hours. The narcotic treatment physician timesheets reviewed documented 12.5 hours.



The census was 442 for the week of December 23, 2012. One-third of all required narcotic treatment physician time to be provided by a narcotic treatment physician was 14.7 hours. The narcotic treatment physician timesheets reviewed documented 12 hours.



The census was 437 for the week of December 30, 2012. One-third of all required narcotic treatment physician time to be provided by a narcotic treatment physician was 14.5 hours. The narcotic treatment physician timesheets reviewed documented 12 hours.



The census was 444 for the week of January 6, 2013. One-third of all required narcotic treatment physician time to be provided by a narcotic treatment physician was 14.8 hours. The narcotic treatment physician timesheets reviewed documented 12.5 hours.



The census was 443 for the week of January 13, 2013. One-third of all required narcotic treatment physician time to be provided by a narcotic treatment physician was 14.7 hours. The narcotic treatment physician timesheets reviewed documented 12.5 hours.



The census was 445 for the week of January 20, 2013. One-third of all required narcotic treatment physician time to be provided by a narcotic treatment physician was 14.8 hours. The narcotic treatment physician timesheets reviewed documented 12 hours.



The Facility Director and Clinical Supervisors were interviewed on January 31, 2013 and confirmed the findings.
 
Plan of Correction
A follow-up inspection was conducted on January 31, 2013 by the Division of Drug and Alcohol Program Licensure. DHNPA Program Director met with the Medical Director, Physician Assistant, Nurse Manager and Clinical Supervisors on 2/2/2013 and again on 2/11/2013 to discuss the deficiencies . Program Director reviewed 715. (e) Licensure Physician Staffing and held a training on how to calculate the required information. The team was provided a spreadsheet and a copy of the state regulations. Program Director assigned a Clinical Supervisor who along with Program Director will be responsible for monitoring the Medical Directors and Physician Assistance hours to insure the hours are in compliance according to DHNPA census and within the state regulations. This will be monitored by the Program Director on a weekly basis.
